What does North Dakota require of your registered agent?

Governing statute: N.D.C.C. ch. 10-01.1 (North Dakota Registered Agents Act); LLCs are governed by N.D.C.C. ch. 10-32.1
Corporations, LLCs and partnerships other than general partnerships must maintain a North Dakota registered agent with a physical North Dakota address. If you name a noncommercial registered agent, your filing must include that agent’s complete physical North Dakota address; if you name a commercial registered agent listed with the Secretary of State, you do not restate the address.
The Registered Agents Act does not set office hours. It requires an agent for service of process at a physical North Dakota address, and every notice the Secretary of State sends — annual report reminders, not-good-standing warnings, dissolution notices — goes to that registered agent address, so somebody has to be there to read it.
If you have no agent
Naming an agent who never approved the appointment can lead to involuntary dissolution. If your agent resigns and you do not appoint a replacement, the Secretary of State places the business in Not Good Standing and can involuntarily dissolve or terminate it, or revoke a foreign entity’s authority, and service of process can then be made on the Secretary of State under N.D.C.C. § 10-01.1-13.
